Neither uBid4it Canada Classifieds nor any of providers of information shall have any liability for the accuracy of the information contained in the service, or the contents of any advertisements, or for assertions or omissions therein. No party shall be liable to any other party or any third-party for third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. uBid4it Canada Classifieds reserves the right to remove any listings or any advertisements for any reason. In no case shall uBid4it Canada Classifieds be liable for any costs or events that occur beyond its control including, but not limited to, network outages, Internet connectivity problems and client side browser issues.

The following disclaimer and terms of use apply generally to all postings to the uBid4it Canada Classifieds site It is hereby also understood that any person posting to uBid4it Canada Classifieds will have been presented with this disclaimer and terms of use prior to doing so and, as such, be subject to its terms as indicated below.

You are entirely responsible and liable for all postings to uBid4it Canada Classifieds. Listed below are some, though not all, violations which may result in uBid4it Canada Classifieds deleting your postings. You agree not to do any of the following requests while posting an ad to uBid4it Canada Classifieds.

• harass, threaten, embarrass or slander any person or entity;
• transmit via uBid4it Canada Classifieds any information, data, text, files, links, software, chat, communication or other materials ("Content") that uBid4it Canada Classifieds considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, racially, ethnically or otherwise objectionable;
• impersonate in uBid4it Canada Classifieds any business or person, living or dead, famous or not;
• intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to any regulations having the force of law while using or accessing uBid4it Canada Classifieds or in connection with your use of uBid4it Canada Classifieds in any manner.

You agree that you will not upload or transmit any Content to uBid4it Canada Classifieds that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party. By submitting Content to uBid4it Canada Classifieds you automatically grant -- or warrant that the owner of such Content has expressly granted -- uBid4it Canada Classifieds the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any Rights that may exist in such Content.

You must evaluate, and bear the risk associated with, the accuracy, completeness or usefulness of any Content. uBid4it Canada Classifieds shall not be responsible for any Content. uBid4it Canada Classifieds does not prescreen or monitor all Content as a matter of policy, but uBid4it Canada Classifieds shall have the right, but not the responsibility, to remove Content which is deemed in sole discretion harmful, offensive, or otherwise in violation of this Agreement or any rules uBid4it Canada Classifieds has in place at the time. uBid4it Canada Classifieds may elect at its sole discretion to monitor some, all, or no areas of uBid4it Canada Classifieds for adherence to this Agreement or rules.

CONDUCT

You agree not to post, email, or otherwise make available Content:

• that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of anothers privacy, or is harmful to minors in any way;
• that is pornographic or depicts a human being engaged in actual sexual conduct including but not limited to (i) sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex, or (ii) bestiality, or (iii) masturbation, or (iv) sadistic or masochistic abuse, or (v) lascivious exhibition of the genitals or pubic area of any person;
• that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
• d that violates the Fair Housing Act by stating, in any notice or ad for the sale or rental of any dwelling, a discriminatory preference based on race, color, national origin, religion, sex, familial status or handicap (or violates any state or local law prohibiting discrimination on the basis of these or other characteristics);
• that violates federal, State/Provincial, or local equal employment opportunity laws, including but not limited to, stating in any advertisement for employment a preference or requirement based on race, color, religion, sex, national origin, age, or disability.
• with respect to employers that employ four or more employees, that violates the anti-discrimination provision of the Immigration and Nationality Act, including requiring Canada/U.S.A. citizenship or lawful permanent residency (green card status) as a condition for employment, unless otherwise required in order to comply with law, regulation, executive order, or federal, State/Provincial, or local government contract.
• that impersonates any person or entity, including, but not limited to, a uBid4it Classifieds employee, or falsely states or otherwise misrepresents your affiliation with a person or entity (this provision does not apply to Content that constitutes lawful non-deceptive parody of public figures.);
• that includes personal or identifying information about another person without that persons explicit consent;
• that is false, deceptive, misleading, deceitful, misinformative, or constitutes "bait and switch";
• that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or Content that you do not have a right to make available under any law or under contractual or fiduciary relationships;
• that constitutes or contains "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement;
• that constitutes or contains any form of advertising or solicitation if: posted in areas of the uBid4it Classified sites which are not designated for such purposes; or emailed to uBid4it Classified users who have not indicated in writing that it is ok to contact them about other services, products or commercial interests.
• that includes links to commercial services or web sites, except as allowed in "services";
• that advertises any illegal service or the sale of any items the sale of which is prohibited or restricted by any applicable law, including without limitation items the sale of which is prohibited or regulated by Provincial/Federal laws. • that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
• that disrupts the normal flow of dialogue with an excessive amount of Content (flooding attack) to the Service, or that otherwise negatively affects other users ability to use the Service; or
• that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of Content transmitted through the Service. Additionally, you agree not to:
• contact anyone who has asked not to be contacted, or make unsolicited contact with anyone for any commercial purpose;
• "stalk" or otherwise harass anyone;
• collect personal data about other users for commercial or unlawful purposes;
• use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Service - unless expressly permitted by uBid4it Classifieds;
• post non-local or otherwise irrelevant Content, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on our infrastructure;
• post the same item or service in more than one classified category or forum, or in more than one metropolitan area;
• attempt to gain unauthorized access to uBid4it Classifieds computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service or the uBid4it Classifieds website; or
• use any form of automated device or computer program that enables the submission of postings on uBid4it Classifieds without each posting being manually entered by the author thereof (an "automated posting device"), including without limitation, the use of any such automated posting device to submit postings in bulk, or for automatic submission of postings at regular intervals;
• use any form of automated device or computer program ("flagging tool") that enables the use of uBid4it Classifieds "flagging system" or other community moderation systems without each flag being manually entered by the person that initiates the flag (an "automated flagging device"), or use the flagging tool to remove posts of competitors, or to remove posts without a good faith belief that the post being flagged violates these Term of Use.

Note: We reserve the right, at our sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such modifications shall become effective immediately upon the posting thereof. You must review this agreement on a regular basis to keep yourself apprised of any changes. You expressly agree that use of uBid4it Canada Classifieds is at your own risk. uBid4it Canada Classifieds shall not be responsible to you for any content found on uBid4it Canada Classifieds . uBid4it Canada Classifieds expressly disclaims all warranties of any kind, whether implied warranties of merchantability, fitness for a particular purpose, and noninfringement. uBid4it Canada Classifieds makes no warranty that uBid4it Canada Classifieds will be timely, secure, error free, or meet your requirements; nor does uBid4it Canada Classifieds make any warranty as to the results that may be obtained from the use of uBid4it Canada Classifieds or as to the accuracy or reliability of any information obtained through uBid4it Canada Classifieds. No advice or information, whether oral or written obtained by you from uBid4it Canada Classifieds shall create a warranty not expressly made herein. You understand and agree that any content downloaded or otherwise obtained through the use of uBid4it Canada Classifieds is done at your own discretion and risk and that you will be solely responsible for any damages to your computer or loss of data that results in the downloads of such content. To the full extent permissible under the applicable law, uBid4it Canada Classifieds shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use uBid4it Canada Classifieds or for the cost of procurement of substitute goods and services resulting from any goods or services purchased or obtained through your use of the uBid4it Canada Classifieds classified ads system.
